THIS IS THE LAST WILL AND TESTAMENT of me Edward Bunning of Cosby in the County of Leicester Yeoman which I make in manner following that is to say I give and devise All my Messuages Cottages Tenements Closes Lands and Hereditaments situate at Cosby aforesaid or in the Parish Lordship or Liberties thereof and heretofore in the occupation of my Father late of myself and now of William Holland Thomas Bunning Thomas Hollick Thomas Cobley and Thomas Yeomans And all other my Real Estate whatsoever Unto my friends William Hardy the Younger of Cosby aforesaid Butcher and William Clemens of Great Glenn in the said County of Leicester Baker their Heirs and Assigns Upon trust that the said William Hardy and William Clemens and the Survivor of them his Heirs and their or his Assigns do and shall as soon as conveniently may be after my decease sell and dispose of my said Messuages Cottages Tenements Closes Land Hereditaments and Real Estate by public auction or private contract and either altogether or in Lots and buy in and re sell the same at any future auction or by private contract without being answerable for any diminution in price which may happen thereby

And as to the Monies to arise from the sale or sales of my said Messuages Cottages Tenements Closes Land Hereditaments and Real Estate and the Rents and Profits thereof until the same shall be sold or the Purchases or respective Purchasers shall be entitled thereto Upon trust that the said William Hardy and William Clemens and the Survivor of them his Heirs and their or his Assigns do and shall receive the same and stand possessed thereof upon the trusts and for the intents and purposes hereinafter expressed and declared concerning the same that is to say Upon trust that the said William Hardy and William Clemens and the Survivor of them his Heirs and their or his Assigns do and shall thereout in the first place pay all Principal and Interest Monies due on Mortgage of my said Messuages Cottages Tenements Closes Land Hereditaments and Real Estate and in the next place pay all my just debts funeral and testamentary expences

And as to the Residue of the said Trust Monies Upon trust that the said William Hardy and William Clemens and the Survivor of them his Heirs and their or his Assigns do and shall place out the same on Government or Real Security in England and pay the Interest Dividends or Annual produce thereof unto my Wife Elizabeth Bunning and her Assigns during her life by two equal half yearly payments

And immediately after the decease of my said Wife Upon trust that the said William Hardy and William Clemens and the Survivor of them his Heirs and their or his Assigns do and shall pay one Moiety or equal half part of the said Trust Monies unto my son Samuel Bunning his Executors Administrators and Assigns to and for his and their absolute use and benefit

And as to the other Moiety or equal half part of the said Trust Monies Upon trust that the said William Hardy and William Clemens and the Survivor of them his Heirs and their or his Assigns do and shall pay and equally divide the same unto and between my Sons Thomas Bunning and William Bunning their respective Executors Administrators and Assigns to and for his and their absolute use and benefit

And I hereby declare that the Person or Persons who shall become the Purchaser or Purchasers of all or any part of my said Messuages Cottages Tenements Closes Land Hereditaments and Real Estate and shall pay his her or their purchase money or purchase monies or any part thereof to the said William Hardy and William Clemens or the Survivor of them his Heirs or their or his Assigns and shall obtain his or their Receipt or Receipts for the same that such Receipt or Receipts shall be a sufficient and effectual discharge or sufficient and effectual discharges for the same purchase monies respectively or so much thereof respectively as in any such Receipt or Receipts should be expressed or acknowledged to be received and that the Person or Persons to whom such Receipt or Receipts respectively should be given his her or their Heirs Executors Administrators or Assigns should not afterwards be answerable or accountable for any loss misapplication or nonapplication or be in anywise obliged or concerned to see to the application of the money therein expressed or acknowledged to be received or any part thereof

And I hereby declare that on the death refusal or incapacity to act of either of them the said William Hardy and William Clemens or of any Trustee or Trustees to be appointed in his or their place or stead it shall be lawful for the acting Trustee or Trustees of this my Will or the Executors or Adminstrators of the last acting Trustee to appoint a new Trustee or Trustees in the place or stead of such Trustee so dying refusing or becoming incapable to act as aforesaid and thereupon the said Hereditaments Trust Estate and Premises shall be conveyed and assured so that the same may vest in such new Trustee or Trustees jointly with the surviving or continuing Trustee or Trustees or solely as the case may require and in his her or their Heirs Executors Administrators and Assigns to the uses upon the trusts and for the ends intents and purposes hereinbefore declared and that every such new Trustee shall have and may exercise the same powers and authority as if he had been appointed a Trustee by this my Will

And that the Trustees appointed by this my Will or to be appointed as aforesaid shall not be answerable for the other of them or for the acts deeds or defaults of the other of them nor for involuntary losses nor for money received under Receipts in which they shall join only for conformity

And that the present and every future Trustee shall and may reimburse themselves and each other out of the said trust Monies or out of any Monies that may come into their Hands by virture of the Trusts of this my Will all costs and expences to be incurred by them in the execution of the Trusts aforesaid or in anywise in relation thereto

I give and bequeath All my Household Goods and Furniture Money and Securities for Money Personal Estate and Effects whatsoever unto my said Wife to and for her own absolute use and benefit

And I appoint the said William Hardy and William Clemens Executors of this my Will and hereby revoke all other Wills by me at any time heretofore made and do declare this present writing contained on this and the two preceding sheets of paper to be my last Will and Testament

In witness whereof I have hereunto set my Hand to the two preceding sheets and my Hand and Seal to this third and last sheet the eighteenth day of March in the Year of our Lord One thousand eight hundred and thirty seven.

Let a Probate be made to William Hardy the Younger of Cosby Butcher and William Clements [in the Will spelt Clemens]of Great Glenn, Tanner, and grazier, [in the Will called Baker] both in the County of Leicester, the joint Executors named in the Will of the deceased

They having been first duly sworn as well to the faithful execution of the Will as that the Testators Goods Chattels and Credits without deducting any debts due and owing by him therefrom do not amount in value to the Sum one hundred pounds and that the deceased died on 23rd day of Jany last

Will of William Bunning of Cosby, Mullica Hill, New Jersey, USA
Dated 22 July 1873 - Died 27 July 1873


I William Bunning Sr of Mullica Hill in the Township of Harrison in the County of Gloucester and State of New Jersey being very feeble in body, but of sound mind memory and understanding do make and publish this my last Will and Testament in manner following; to wit

Item  I do order and direct my Executor hereinafter named so soon after my decease as convenient to pay my funeral expenses and just debts.
Item  I do give and bequeath to my brother Thomas Bunning Sr the sum of Two Hundred Dollars.
Item  I do give and bequeath to my nephew Thomas Bunning Jr the sum of Two Hundred Dollars.
Item  I do give and bequeath to my nephew and namesake William Bunning Jr the Sum of Two Hundred Dollars.
Item  I do give and bequeath to my nephew David Bunning son of Thomas Bunning Sr the Sum of one Hundred and fifty dollars.
Item  I do give and bequeath to my sister in law Rebecca Bunning wife of Thos. Bunning the sum of one Hundred Dollars.
Item  I do give and bequeath to Sarah Williamson my carriage
Item  I do give and bequeath to my niece Ann Martin the sum of Two Hundred Dollars.
Item  I do give and bequeath to my niece Mary Cassaday the sum of Two Hundred Dollars minus the note I hold against her.
Item  I do give and bequeath to Miss Voss my reputed daughter the sum of twenty pounds sterling.
Item  I do give and bequeath to the mother of said Miss Voss the sum of twenty pounds sterling
Item  I do give and bequeath to my brother Samuel Bunning Sr the sum of forty pounds sterling
Item  I do give and bequeath to the wife of said Samuel Bunning Sr the sum of twenty pounds Sterling
Item  I do give and bequeath to each of his two daughters, of the said Samuel Bunning Sr, the sum of forty pounds sterling
Item  I do give and bequeath to the grand daughter (Bertha) of said Samuel Bunning Sr the sum of twenty pounds sterling
Item  I do give and bequeath to Mrs Samuel Bunning Jr the sum of twenty pounds sterling
Item  I do order and direct that the interest of the balance of my estate shall be paid to my half brother John Bunning during his natural life and at the expiration of his natural life the principal to be paid to Samuel Theodore Bunning

Lastly I do name constitute and appoint my friend William Haines as my Executor of this my last will and testament.

Signed, sealed, published and declared by the said William Bunning Sr to be his last will and testament in the presence of us who subscribe our names at the testators request in the presence of the same and of each other this twenty second day of July A. D. 1873
